By accessing or using Simple Flowers ("Service") at flowersdeliverednearme.com, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, do not use the Service.
2. Service Description
Simple Flowers provides same-day flower delivery in the Seattle area. We source flowers from local stores and florists and arrange delivery to your specified address. Availability, pricing, and delivery windows are subject to change.
3. Orders and Payment
When you place an order, you agree to pay the stated price including any applicable taxes. Payment is processed securely through our payment processor. All sales are final unless otherwise stated in our refund policy. We reserve the right to refuse or cancel orders at our discretion.
4. Delivery
We deliver to the address you provide. You are responsible for ensuring the address is correct and that someone can receive the delivery during the selected window. We are not liable for failed deliveries due to incorrect addresses, inaccessible locations, or recipient unavailability. Same-day delivery is subject to order cutoff times (e.g., order by 1 PM PST for ASAP delivery).
5. Refunds and Cancellations
Cancellations must be requested before your order has been prepared or dispatched. Refunds for cancelled orders will be processed according to our refund policy. If you experience an issue with your order, contact us at support@flowersdeliverednearme.com and we will work to resolve it.
6. Consent to Communications
By placing an order and checking the consent box, you agree to receive order-related emails and text messages (SMS), including confirmations and delivery updates. Message and data rates may apply for SMS. You consent to our Privacy Policy and these Terms.

To the fullest extent permitted by law, Simple Flowers and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising from your use of the Service. Our total liability for any claim shall not exceed the amount you paid for the order in question.
8. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.
9. Governing Law
These Terms are governed by the laws of the State of Washington, without regard to conflict of law principles. Any disputes shall be resolved in the courts of King County, Washington.

We may modify these Terms at any time. Continued use of the Service after changes constitutes acceptance. Material changes will be indicated by an updated "Last updated" date.
